The Maryland Court of Appeals decided on April 15, 2008 that the Condo Act does not require a condominium to repair or replace property of an owner in an individual condominium unit after a casualty loss. Only damage to common elements or the structure of a condominium need be covered. Maryland Senator Delores Kelley (Baltimore County) gave a riveting presentation of her 10 year attempt to get either Baltimore County or the state to help her HOA, Pikeswood Village Homeowners Association. Senator Kelley described incidences of property managers getting the Board changed without elections when they didn’t like the existing Board members.
